These Terms of Service ("Terms") govern your access to and use of the Artisanal Aqua website and your purchases of our products. Puredot Inc dba Artisanal Aqua ("we," "us," or "our") provides this website and sells fine bottled waters subject to the terms below. By accessing the site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree with any part of them, please do not use the site or place an order. We recommend that you read these Terms carefully and keep a copy for your records.

Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, and able to enter into a legally binding contract in order to purchase from us. By placing an order, you represent and warrant that you meet these requirements and that the information you provide to us is accurate and complete.

Products and pricing

We aim to describe our products, their origins, and their prices as accurately as possible. However, we do not warrant that product descriptions, images, pricing, or other content on the site are entirely accurate, complete, current, or error-free. Colors, labels, and packaging may vary from the images shown, and producers may change their bottles or formulations from time to time. All prices are listed in United States dollars and are subject to change without notice. In the event that a product is listed at an incorrect price or with incorrect information due to a typographical, pricing, or other error, we reserve the right to correct the error and to refuse or cancel any orders placed at the incorrect price, whether or not the order has been confirmed, refunding any payment already taken.

Orders and acceptance

Your submission of an order constitutes an offer to purchase the products in that order. All orders are subject to acceptance by us, and we accept your order when we ship the products to you. Until that point, we reserve the right to decline, cancel, or limit the quantity of any order for any reason, including suspected fraud, errors in pricing or product information, or limited availability. If we cancel an order after payment has been taken, we will issue a refund for the affected items.

Payment

Payment is taken at checkout through our third-party payment processor. By providing a payment method, you represent and warrant that you are authorized to use it and that the payment information you provide is true and accurate. You authorize us and our payment processor to charge your chosen payment method for the total amount of your order, including any applicable shipping charges and taxes. We are not responsible for any fees charged by your bank or card issuer.

Shipping, title, and risk of loss

We currently ship within the United States only. Delivery times shown at checkout are estimates provided by the carrier and are not guaranteed. Full details of our shipping practices, including processing times, tracking, and how we handle damaged shipments, are set out in our Shipping & Returns policy, which forms part of these Terms. Breakage or damage in transit is handled under that policy. Please review it before placing an order.

Returns and refunds

Because our products are consumable food-grade goods sold in sealed bottles, we are generally unable to accept returns or exchanges once an order has been delivered, except in the case of damaged shipments or order errors as described in our Shipping & Returns policy. Any refunds we issue will be made to the original payment method used for the purchase.

Acceptable use

You agree to use the site only for lawful purposes and in accordance with these Terms. You agree not to misuse the site, interfere with or attempt to disrupt its operation or security, access it through automated means without our permission, infringe our intellectual property or that of others, or submit false, misleading, or fraudulent information, claims, or altered evidence. We reserve the right to suspend or terminate access, and to refuse service, to anyone who violates these Terms.

Intellectual property

All content on this website, including text, graphics, logos, images, and the "Artisanal Aqua" name and branding, is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the site without our prior written permission. Product names, brands, and trademarks of the waters we sell remain the property of their respective owners.

Disclaimer of warranties

The website and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, except as required by applicable law. We do not warrant that the site will be uninterrupted, secure, or error-free. Any statements about the mineral content, source, or characteristics of our products are provided for general information and are based on information supplied by producers.

Limitation of liability

To the fullest extent permitted by law, Artisanal Aqua and its owners, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the site or products, whether based on contract, tort, or any other legal theory. To the extent liability cannot be excluded, our total liability for any claim arising out of or relating to an order shall not exceed the amount you paid for that order.

Indemnification

You agree to indemnify and hold harmless Artisanal Aqua and its owners and employees from any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the site, or your violation of any law or the rights of a third party.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or your use of the site will be subject to the exclusive jurisdiction of the state and federal courts located in New York.

The current version is always posted here, and your continued use of the site or placement of an order after any change constitutes acceptance of the updated Terms.
